01 Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer", "User") and InstaPay Credit Card ("we", "us", "our"). By calling, WhatsApp-ing, or otherwise engaging with our services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

02 Eligibility

To use our services, you must meet all of the following criteria:

• Be at least 18 years of age.
• Be the rightful and authorized holder of the credit card used for the transaction.
• Hold a valid bank account in your own name for receiving transfers.
• Have a valid government-issued photo ID (Aadhaar, PAN, Passport, etc.).
• Provide accurate and truthful information throughout the transaction process.

By using our services, you confirm that you meet all of the above criteria.

03 Nature of Service

InstaPay Credit Card facilitates the conversion of available credit card limit into liquid cash, which is then transferred to the customer's designated bank account or provided as physical cash. Our services include:

• Instant spot cash against credit card limit.
• Credit card to bank account money transfer (with or without physical swipe).
• Credit card bill payment (card-to-card).
• Utility and non-utility payment link services.

04 Service Charges

Service fees are applied to every transaction processed through InstaPay Credit Card:

• Instant spot cash: Applicable charges apply.
• Next-day settlement: Applicable charges apply.
• Bank transfer (instant): Charges vary depending on card type and bank.
• Special/festive offers: As communicated at the time of transaction.

All charges are communicated transparently before transaction initiation. Service charges are non-refundable once a transaction is successfully completed. Charges are in addition to any interest or fees levied by your credit card issuing bank.

05 Customer Responsibilities

As a customer, you are solely responsible for:

• Ensuring you are the authorized cardholder and that the card is in good standing.
• Verifying that your credit card has sufficient available limit before initiating a transaction.
• Providing accurate and complete bank account details for fund transfers.
• Ensuring compliance with all applicable laws, including tax obligations, when receiving funds.
• Understanding the financial implications of credit card cash advance features including interest charges from your issuing bank.
• Not using our services for any illegal, fraudulent, or unauthorized purposes.

06 Transaction Processing

Transactions are typically processed within 2 minutes of initiation. However, processing times may vary based on:

• Bank processing times and network availability.
• Technical issues with third-party payment gateways.
• Additional verification requirements for high-value transactions.
• Time of day and banking hours for certain transfer types.

InstaPay Credit Card shall not be liable for delays caused by third-party banking systems, network failures, or circumstances beyond our reasonable control.

07 Prohibited Activities

You agree not to use InstaPay Credit Card's services for any of the following:

• Money laundering or any activity prohibited under the Prevention of Money Laundering Act (PMLA), 2002.
• Financing of illegal activities, terrorism, or any prohibited organizations.
• Circumvention of tax obligations or evasion of financial regulations.
• Fraudulent transactions including use of stolen or unauthorized credit cards.
• Any activity that violates applicable Indian laws or regulations.

08 Limitation of Liability

InstaPay Credit Card's total liability to you in connection with any transaction shall be limited to the service charges collected for that specific transaction. We are not liable for:

• Any interest, penalties, or fees charged by your credit card issuing bank.
• Any indirect, incidental, special, or consequential damages.
• Loss of profits, business, or goodwill arising from the use or inability to use our services.
• Delays or failures caused by third-party banking systems or payment networks.

09 Intellectual Property

All content on the InstaPay Credit Card website and communications, including logos, branding, text, and graphics, is the property of InstaPay Credit Card and is protected under applicable intellectual property laws. You may not reproduce, distribute, or use any content without our express written consent.

10 Termination

We reserve the right to terminate or refuse service to any person at any time, for any reason, including but not limited to suspected fraudulent activity, violation of these Terms, or legal requirements. Termination does not affect any rights or obligations that accrued prior to termination.

11 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes, claims, or controversies arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

12 Amendments

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of our services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
